Basic Terms

1. You must be at least 13 years old to use the Service. If you are between 13 years and 18 years old, your legal guardian has reviewed and agrees to these terms and Privacy policy for you to use the Services.

7. You must not create accounts with the Service by using an automated device or through any other unauthorized means.

8. You must not use services for fraudulent or abusive purposes including, without limitation, by using our Services to impersonate any person or entity, or otherwise misrepresent your affiliation with a person, entity, our Services or our games;

9. You are solely responsible and accountable for your actions.

10. You agree that Giritech is not accountable or liable for the conduct of other users.

11. Violation of any of these Terms of Use may, in Giritech's sole discretion, result in termination of your account.

12. You acknowledge and agree that Giritech cannot and will not be responsible for the Content posted on the Service.

13. You understand that you use the Service at your own risk. We can stop providing all or part of the Service to you, if you violate the letter or essence of these Terms of Use, or otherwise cause risk or possible legal exposure for Giritech.

14. You must not use services to harm anyone or to cause offence to harass any person.

15. You must not use the Services for any commercial use, or to advantage third parties or facilitate the sending of any advertisement or spam.

16. You must not remove or amend any proprietary notices or other ownership information from the Services; You must not attempt to decompile, reverse engineer, disassemble or hack the Services, or to defeat or overcome any of the encryption technologies or security measures or data transmitted, processed or stored by us.

You must not 'harvest', 'scrape' or collect any information about or regarding other people that use the Services, including, but not limited to any personal data or information (including by uploading anything that collects information including but not limited to 'pixel tags' cookies, graphics interchange formats ('gifs') or similar items that are sometimes also referred to as 'spyware’.

General Conditions

1. We hold the right to modify or terminate the Service or your access to the Service without any cause, without notice, at any time, and without liability to you. User's account can be deleted in the profile section. Effecting termination, All the stored data are deleted including all access to the profile and comments or games data uploaded by the user.

2. We reserve the right to forfeiture of any username for any reason at our discretion.

3. We may, but have no obligation to, remove, edit, block, and/or monitor Content or accounts containing Content that we determine in our sole discretion violates these Terms of Use.

4. You agree and acknowledge that you are responsible for all data charges or internet charges you incur through use of the Service.

Rights

1. Giritech does not claim ownership of any Content that you post on or through the Service. You must comply with the laws that apply to you in the location that you access the Services from. If any laws applicable to you restrict or prohibit you from accessing Services, you must comply with those legal restrictions or, if applicable, stop accessing the Services. You agree that, to the best of your knowledge, all the information you provide to us on accessing the Services is and shall remain true, accurate and complete at all times. Information, data, software, sounds, photos, video tags, or other materials (Content) may be sent, uploaded, communicated, transmitted or otherwise made available via Services by you or by others. You should therefore only share Content that you are comfortable sharing publicly. You understand and agree that all Content that you may be sent when using our Services, whether publicly posted or privately sent, is the sole responsibility of the person that sent the Content. 2. Giritech may display advertisements and promotions, and you hereby agree and acknowledge that Giritech may place such advertising and promotions on the Service or on, about, or in conjunction with your Content.

The Service contains content owned or licensed by Giritech ("Giritech Content") which is protected by copyright, trademark, patent, trade secret and other laws, and Giritech solely owns and reserves all rights in the Giritech Content and the Service. You will not remove, modify or conceal any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Giritech Content and you will not reproduce, modify, adapt, develop derivative works based on, perform, display, publish, distribute, transmit, broadcast, sell, license or otherwise exploit the Giritech Content.

4. There will be occasions when the Service may be interrupted due scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment, even though it is Giritech 's aim for the Service to be available as much as possible. Also, Giritech reserves the right to remove any Content from the Service with or without any reason, without any prior notice. Content removed from the Service may continue to be stored by Giritech, including, without limitation, in order to comply with certain legal obligations, but may not be retrievable without a valid court order. Thus, Giritech encourages you to maintain your own backup of your Content. Giritech is not a backup service, and you agree that you will not rely on the Service for the purposes of Content backup or storage. Giritech will not be liable to you for any modification, suspension, or discontinuation of the Services, or the loss of any Content. You also acknowledge that the Internet may be subject to breaches of security and that the submission of Content or other information may not be secure.

5. You agree that Giritech is not responsible for, and does not endorse, Content posted within the Service. Giritech does not hold any obligation to pre-screen, monitor, edit, or remove any Content. If your Content violates these Terms of Use, you may endure legal responsibility for that Content.

6. Any Content will be non-confidential and non-proprietary, and we will not be liable for any use or disclosure of Content, except as otherwise given in the Service's Privacy Policy, available at https://dragon.gamegiri.com/Privacy_policy.html as between you and Giritech. You acknowledge and agree that your relationship with Giritech is not a confidential, fiduciary, or other type of special relationship, and that your decision to submit any Content does not place Giritech in a position that is any different from the position held by members of the general public, including with regard to your Content. None of your Content will be subject to any obligation of confidence on the part of Giritech, and Giritech will not be liable for any use or disclosure of any Content you provide.

Reporting Copyright and Other IP Violations

1. We respect other people's rights and expect you to do the same.

2.If you infringe the intellectual property rights held by others, we will disable your account when appropriate.

Disclaimer of Warranties

THE SERVICE, INCLUDING, WITHOUT LIMITATION, GIRITECH CONTENT, IS PROVIDED ON AN "AS IS", "AS AVAILABLE" AND "WITH ALL FAULTS" BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, NEITHER GIRITECH NOR ITS PARENT COMPANY NOR ANY OF THEIR EMPLOYEES, MANAGERS, OFFICERS OR AGENTS (COLLECTIVELY, THE " GIRITECH PARTIES") MAKE ANY REPRESENTATIONS OR WARRANTIES OR ENDORSEMENTS OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, AS TO: (A) THE SERVICE; (B) THE GIRITECH CONTENT; (C) USER CONTENT; OR (D) SECURITY ASSOCIATED WITH THE TRANSMISSION OF INFORMATION TO GIRITECH OR VIA THE SERVICE. IN ADDITION, THE GIRITECH PARTIES HEREBY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, CUSTOM, TRADE, QUIET ENJOYMENT, SYSTEM INTEGRATION AND FREEDOM FROM COMPUTER VIRUS.

BY ACCESSING OR USING THE SERVICE YOU REPRESENT AND WARRANT THAT YOUR ACTIVITIES ARE LAWFUL IN EVERY JURISDICTION WHERE YOU ACCESS OR USE THE SERVICE.

Data Deletion Request:

You hold the right to have your personal data deleted. You can submit a request to us by sending an email with your login information to contact@gamegiri.com, if you wish to delete your data or deactivate your account. We will delete all personal data or deactivate your account within 72 hours and provide you with a confirmation email for the same.

Arbitration

Indian Laws shall govern these 'Terms of Use'. If any dispute is not resolve amicably by the parties to the dispute within 30 days after arising of the dispute, then the Arbitration and Conciliation Act, 1996, including any rules made thereunder, shall be followed and the decision announced by the arbitral tribunal shall be final and binding on all the parties.

With the help of a common agreement, one arbitrator will be appointed by Giritech. The arbitration will be conducted in English at New Delhi, India. Every party has the rights to appeal for any judicial relief in any court having jurisdiction against their rights until dispute is resolved.

Jurisdiction

These Terms of Use are subject to Indian laws and the Courts at New Delhi, India shall have the exclusive jurisdiction in respect of any disputes or any matter arising here from these Terms of Use.

Waivers of our Rights:

Our failure to exercise or enforce any of our rights under these terms does not waive our right to enforce such right. Any waiver of such rights shall only be effective if it is in writing and signed by us.
